GENERAL CONDITIONS OF SALE of the "KOSHERFOODINEUROPE.COM" service

These general conditions of sale (the "General Conditions"), reported here, constitute the terms of use of the "KOSHERFOODINEUROPE.COM" service (the "Service") provided by KOSHERFOODINEUROPE.COM Milan Company Register no. REA 1825, VAT number no. IT 058390961 and apply to all orders (the "Orders" or the "Order") placed by customers through the KOSHERFOODINEUROPE.COM website (the "Site")

KOSHERFOODINEUROPE.COM observes the legislation regarding contracts concluded at a distance pursuant to art. 49 and following of Legislative Decree 206/2005.

Please carefully read these General Conditions below, which constitute a binding agreement for the use of the Service and the use of the Site, with an invitation to print them and/or save them on another durable medium of your choice.

These Conditions may be modified at any time by KOSHERFOODINEUROPE.COM; any changes will be in force from the moment of publication on the Site and will apply only to sales concluded after the publication itself.

PUBLIC OFFER

All products and prices indicated on the Site and/or App constitute an offer to the public with the limitations and methods contained in these Conditions. The retail sale to the final consumer of the products present and orderable on the Site may be intended for entrepreneurial or professional activities.

KOSHERFOODINEUROPE.COM SERVICE

The Site allows the customer to use the Service, after registering on the aforementioned Site, and place the Order by choosing between the different services and related delivery methods listed during check out.

PRODUCTS

KOSHERFOODINEUROPE.COM reserves the right to modify at any time the assortment of products offered, as well as their prices and/or characteristics.

In any case KOSHERFOODINEUROPE.COM will not make any changes to the price or description of the products after KOSHERFOODINEUROPE.COM has sent the Order confirmation to the customer.

The photo of the product, the information on the ingredients, allergens, Kosher certification and the expiry date of the products inserted on the site coincides with that of the products that will be delivered to the customer.

In the case of purchasing "variable weight products", i.e. products whose actual weight is determined only at the time of their preparation and/or weighing (e.g. meat, poultry etc. some cured meats and cheeses), the prices are proposed on the Site in indicative measurements and weights:

the actual weight may vary up to 20% more or less than what is indicatively proposed on the Site and for this reason, where the expense includes one or more of these products, the weight and amount determined at the time of the Order may differ from the weight and actual amount calculated at the time the receipt is issued;

the amount calculated at the time of the Order will be determined by adding 20% of the total amount of the variable weight products to the total expense.

It follows that the exact amount of the expense will be communicated with the delivery document and therefore only the actual value of the product delivered will be charged.

INDICATION OF THE COUNTRY OF ORIGIN, BREEDING AND SLAUGHTER OF THE PRODUCTS

For meat, the country in which the animal was raised and slaughtered will be indicated.

PRICES AND PROMOTIONS

All prices include VAT.

Prices and promotions are calculated at the time of placing the Order or at the time of modification of the same with subsequent confirmation by KOSHERFOODINEUROPE.COM. Therefore, KOSHERFOODINEUROPE.COM cannot guarantee that the price of the item inserted in the cart remains unchanged between the insertion of the same in the cart and the actual forwarding of the Order (some discounts and/or promotions are valid only for a period limited time, therefore the promotion may expire when the Order is placed).

SHIPPING COSTS

Shipping costs are not included, which will be calculated before checkout from KOSHERFOODINEUROPE.COM to the customer and will be displayed in the order summary before payment.

ACCEPTANCE OF ORDERS

The Order sent by the customer will be binding for KOSHERFOODINEUROPE.COM only if the entire procedure has been completed regularly and correctly without any error messages being highlighted by the Site.

KOSHERFOODINEUROPE.COM will not include in the cart  products not expressly ordered by the customer or accepted as substitute products.

CONFIRMATION, CANCELLATION AND MODIFICATION OF THE ORDER

The customer will receive at the email address indicated at the time of registration:

the Order confirmation containing the summary of the products, the relative prices, the shipping costs.

Please note that the customer will be able to check at any time the summary of the products, the total cost of the Order, the terms for modifying and/or canceling the Order (if applicable), in their personal area and on the Site.

KOSHERFOODINEUROPE.COM, following unforeseen logistical and organizational difficulties, may cancel the Order by notifying the customer via e-mail or, by agreement with the same, change the delivery day.

Orders are also subject to acceptance by KOSHERFOODINEUROPE.COM which reserves, at its sole discretion, not to execute or refuse the Order in the following cases:

incorrect information provided by the customer when placing the Order (for example: incorrect payment card number, or incorrect indication of the security code, incorrect or insufficient delivery address.

In case of refusal or non-execution of the Order, KOSHERFOODINEUROPE.COM will communicate this information to the Customer as soon as possible.

DELIVERY

The delivery service is also guaranteed only for homes that can be reached with the vehicles provided (for example, homes that can only be reached via dirt or exclusively pedestrian roads are excluded).

Upon receipt of the order, the customer must verify that the packages delivered are in good condition and sealed, otherwise the customer must sign the delivery note subject to inspection.

KOSHERFOODINEUROPE.COM will not be responsible for any delays occurring during transport caused by events and/or causes of force majeure or unforeseeable circumstances, such as, but not limited to: natural disasters, adverse weather conditions (such as heavy snowfall), any strikes (of their own or other employees), accidents to means of transport, explosions, or any other cause, similar or different, or for non-delivery due to the absence of the customer.

PRODUCTS NOT AVAILABLE AND PURCHASE LIMITATIONS

KOSHERFOODINEUROPE.COM will not be in any way responsible for the temporary or permanent unavailability of one or more products. In the event of unavailability, even temporary, of the requested products, KOSHERFOODINEUROPE.COM undertakes not to charge the customer the corresponding price. The cases in which limitations apply to the purchase of individual products are highlighted on the site.

FAILURE TO DELIVER

for the delivery of the shopping, the presence of the customer or his representative at the address indicated in the Order is required.

If the customer is not present at the time of delivery, the Order will automatically be placed for delivery the next day or they will be contacted to reschedule the delivery.

If, even after the second attempt, the customer does not collect the shipment for any reason, the order will be considered canceled and the customer will be charged for the cost of delivery and that of the products no longer alienable to third parties (e.g. fresh food products and perishable such as meat, fish, frozen foods, dairy products, cured meats, etc.); KOSHERFOODINEUROPE.COM will also have the right to exclude the customer from the service.

KOSHERFOODINEUROPE.COM does not assume any responsibility if the customer appoints a minor or incapable person for collection, without prejudice, in any case, to the responsibility for the delivery of the parents or legal guardians of the same.

PAYMENT

Payment can be made by the customer online, as specified below:

with credit, debit and prepaid cards enabled for online payments of the MasterCard, Visa, American Express, PayPal, Payplug, BANCOMAT Pay circuits.

Upon confirmation of the Purchase Order, the card issuer is asked for a pre-authorization (blocking of the credit limit or availability of the card) for an amount equal to the total of the Order. The security of online payment is guaranteed by the service provider (the card data is transmitted encrypted directly to the Bank which authorizes the payment in real time).

INVOICE

The issuing of the invoice is mandatory, as our company only issues electronic invoices even if it is not requested by the Customer. The billing data (tax code for private individuals and company data for VAT number) must be entered by the customer during registration.

RIGHT OF WITHDRAWAL

The customer's rights are protected by Legislative Decree 206/2005 as amended. The customer therefore has the right to withdraw from the contract, even partially, without explanation and without additional costs, provided that the withdrawal is communicated by registered letter A/ R to KOSHERFOODINEUROPE.COM - Customer Service KOSHERFOODINEUROPE.COM, Via Tommaso Gulli 19, Milan (MI), or via certified email (PEC) to the address within 14 working days from the day of receipt of the products.

The customer must then return the product at his own expense according to the following methods:

by going to the KOSHERFOODINEUROPE.COM warehouse within 14 working days of receipt

by sending the product, within 14 working days of receipt, to KOSHERFOODINEUROPE.COM Via Tommaso Gulli 19, Milan (MI) 20147

If the withdrawal has been exercised in accordance with the methods described, KOSHERFOODINEUROPE.COM will refund the sum paid for the purchase of the product within 14 days from the date on which it became aware of the exercise of the right of withdrawal by the customer . The refunded amount will be net of delivery costs. The customer will be responsible for the decrease in value of the returned good resulting from handling other than that necessary to establish the nature, characteristics and functioning of the good itself.

Without prejudice to the above, the right of withdrawal is not permitted in the case of:

purchase of sealed packaged products, opened by the Customer;

of goods which by their nature cannot be returned or risk deteriorating or expiring rapidly (e.g. fresh and perishable food products such as fresh, temperature-controlled, delicatessen and frozen products).

SUSPENSION OF THE SERVICE

In the event of serious breaches by the customer (by way of example but not limited to: non-payment of the shopping done, repeated absence of the customer at the time of delivery of the shopping, incorrect use of shopping methods, KOSHERFOODINEUROPE.COM, upon notification written to the customer, reserves the right to suspend the service.

RESPONSIBILITY KOSHERFOODINEUROPE.COM guarantees compliance with the cold chain and, in general, with the quality standards relating to products (in particular food) exclusively until the moment of delivery to the place indicated by the customer; any liability relating to the poor condition of the products due to improper storage subsequent to the time of delivery is excluded.

KOSHERFOODINEUROPE.COM assumes no responsibility for the information provided/acquired by individual producers or distributors.

PROCESSING OF PERSONAL DATA

KOSHERFOODINEUROPE.COM will process the customer's personal data in compliance with the legislation on the processing of personal data as specified in detail in the information released at the time of registration and available on the institutional website www.KOSHERFOODINEUROPE.COM at the following link: Privacy policy

COMPETENT COURT

These General Conditions are governed by Italian law. Any and all disputes relating to the application, execution and interpretation of these General Conditions are under the jurisdiction of the court of the place where the User resides or has elected domicile, if located in Italian territory. If the User's domicile or residence is not within Italian territory, the competent court will be that of execution of the contract.
