1. GENERAL INFORMATION
These Terms and Conditions of Sale govern purchases made through the following websites:

HAMASHBIR DI ELMALEH GAD, operating through KOSHERFOOD.IT and KOSHERFOODINEUROPE.COM, is hereinafter referred to as “we”, “us”, “our” or the “Seller”.
The customer purchasing through the Website is hereinafter referred to as the “Customer”.
These Terms and Conditions apply to all orders placed through the Website and form an integral part of every sales contract concluded between the Seller and the Customer.
By submitting an order, the Customer confirms that they have read, understood and accepted these Terms and Conditions.
The Customer is invited to save or print a copy of these Terms and Conditions for future reference.
2. DEFINITIONS
For the purposes of these Terms and Conditions:
“Website” means https://www.kosherfood.it and https://kosherfoodineurope.com.
“Customer” means any individual, company, organisation, association or other entity placing an order through the Website.
“Consumer” means an individual purchasing products for purposes unrelated to their trade, business, craft or professional activity.
“Professional Customer” means any individual or legal entity purchasing products for purposes connected with a trade, business, craft, professional, institutional or organisational activity.
“Order” means the request submitted by the Customer to purchase one or more products through the Website.
“Products” means the food, beverages, Judaica items, household products or other goods offered for sale through the Website.
“Ambient Products” means products that do not normally require temperature-controlled storage.
“Fresh Products” means chilled or refrigerated products that must be stored at the temperature indicated on their packaging.
“Frozen Products” means products that are normally stored and transported at frozen temperatures.
“Perishable Products” means products that may deteriorate or expire rapidly, including fresh, chilled, refrigerated, frozen, delicatessen, dairy, meat, poultry, fish, prepared food and similar products.
“Carrier” means the independent transport company entrusted with delivering the Order.
3. SCOPE AND APPLICABLE LAW
These Terms and Conditions govern distance sales concluded through the Website.
Sales to Consumers are subject to the mandatory consumer protection provisions applicable under Italian and European Union law.
Nothing in these Terms and Conditions is intended to exclude, restrict or limit any mandatory right granted to Consumers by applicable law.
Where the Customer qualifies as a Professional Customer, the specific provisions relating exclusively to Consumers shall not apply, unless otherwise required by law.
4. CHANGES TO THESE TERMS AND CONDITIONS
We may amend these Terms and Conditions at any time.
The version applicable to an Order is the version published on the Website and accepted by the Customer at the time the Order is submitted.
Any subsequent amendment will apply only to Orders placed after the amended Terms and Conditions have been published.
5. PRODUCTS AND PRODUCT AVAILABILITY
The range of Products available on the Website may be changed at any time.
The display of a Product on the Website does not guarantee that it will remain available until the Order is accepted and prepared.
Product availability may change due to stock levels, supplier availability, seasonal limitations, import restrictions, production delays or other circumstances beyond our reasonable control.
If one or more Products become unavailable after the Order has been placed, we may:
· contact the Customer to propose a suitable replacement;
· remove the unavailable Product and refund the corresponding amount;
· deliver the remaining available Products;
· postpone the Order with the Customer’s agreement; or
· cancel the entire Order if the unavailable Product is essential to the Order.
No replacement Product will be supplied without the Customer’s agreement, unless the Customer has expressly authorised substitutions during checkout or through subsequent communication.
6. PRODUCT INFORMATION AND IMAGES
We make reasonable efforts to ensure that product descriptions and information displayed on the Website are accurate.
However, product images are generally provided for illustrative purposes. Packaging, labels, design, colour, appearance, format, country of production, ingredients, nutritional information and other secondary characteristics may be changed by the manufacturer without prior notice.
The Customer must always check the information printed on the packaging of the Product actually received before consuming or using it.
This is particularly important in relation to:
· ingredients;
· allergens;
· nutritional information;
· storage instructions;
· preparation instructions;
· expiry dates;
· best-before dates;
· country of origin;
· kosher certification; and
· warnings provided by the manufacturer.
The expiry date or best-before date shown in any product image is illustrative and will not necessarily correspond to the Product delivered.
7. ALLERGIES, INTOLERANCES AND SPECIAL DIETARY REQUIREMENTS
Customers with allergies, intolerances, medical dietary requirements or concerns relating to a particular ingredient must contact us before placing an Order.
The Customer must also check the label of each Product received before consumption.
Although we take reasonable care in handling Products, we cannot guarantee the absence of traces of allergens where products are manufactured, stored, prepared or packed in environments where other allergens may be present.
Customers with serious or life-threatening allergies should obtain appropriate professional advice before purchasing or consuming any Product.
8. KOSHER CERTIFICATION
The kosher certification displayed on the Website normally reflects information available to us from the producer, distributor, importer or relevant certification body.
Kosher symbols, certifications, production supervision and approved status may vary depending on:
· the specific product;
· the production facility;
· the production batch;
· the country of production;
· the formulation;
· the packaging; or
· changes introduced by the producer or certification authority.
The Customer must check the kosher symbol and information displayed on the Product actually received.
Customers requiring a specific kosher certification, standard, supervisory authority, level of observance or certification valid for a particular community must contact us before placing the Order.
Unless expressly stated otherwise, the publication of a Product on the Website does not constitute a guarantee that it satisfies every individual or community-specific kosher requirement.
9. COUNTRY OF ORIGIN AND MEAT INFORMATION
Where required by applicable legislation, information relating to the country of origin, breeding, slaughter, production or processing of meat and other Products will be provided on the Product label or accompanying documentation.
Such information may vary between batches and suppliers.
The Customer should contact us before ordering if a specific country of origin, slaughter location, production facility or certification is essential to the purchase.
10. VARIABLE-WEIGHT PRODUCTS
Certain Products, including meat, poultry, fish, cured meats and cheese, may be sold by actual weight.
The quantity displayed on the Website for these Products is an estimated or indicative weight.
The final price is calculated according to:
· the actual weight of the Product prepared for the Customer; and
· the price per kilogram or other unit of measurement displayed on the Website.
The actual weight may reasonably differ from the estimated weight displayed on the Product page.
To permit payment and preparation of the Order, an initial estimated amount may be charged or authorised. This amount may include an additional provisional margin of up to approximately 20% of the estimated value of variable-weight Products.
After the Products have been prepared and weighed:
· only the actual value of the Product supplied will remain payable;
· any excess amount collected will be refunded; and
· where technically possible and expressly accepted by the Customer, any additional amount due may be charged or requested separately.
Any refund will normally be made using the same payment method used for the Order.
The time required for the refund to appear in the Customer’s account depends on the payment provider and the issuing bank and may take 1 to 5 working days.
Small differences caused by the minimum cutting size, natural shape or packaging requirements of the Product may be unavoidable.
11. PRICES
All prices displayed on the Website are expressed in euros (EUR) and include Italian VAT where applicable, unless expressly stated otherwise.
For deliveries outside the European Union, or where the destination country applies local import taxes, the recipient may be required to pay customs duties, import VAT, brokerage fees or other local charges. Unless expressly included at checkout, these amounts are not included in the Product price or shipping cost and are payable by the recipient.
Prices may be changed at any time before the Customer submits an Order.
The price applicable to an Order is the price displayed during checkout when the Order is submitted, subject to:
· variable-weight Products;
· manifest typographical or technical errors;
· incorrect tax calculation;
· shipping quotations requiring manual verification;
· customs charges;
· additional remote-area charges; or
· modifications expressly requested or accepted by the Customer.
If a price is clearly incorrect due to a technical, typographical or system error, we may contact the Customer to request confirmation at the correct price or cancel and refund the affected Product or Order.
12. PROMOTIONS AND DISCOUNT CODES
Promotions, discount codes and special prices may be subject to specific conditions, including:
· a limited validity period;
· minimum spending requirements;
· geographical restrictions;
· product exclusions;
· one use per Customer;
· limited stock; or
· restrictions on combining promotions.
Unless expressly stated otherwise, discount codes cannot be combined with other promotions.
A Product placed in the shopping cart is not reserved and a promotion is not guaranteed until the Order has been successfully submitted.
13. SHIPPING COSTS
Shipping is not free and is not included in the Product prices unless expressly stated otherwise.
We do not apply a general free-shipping threshold. Shipping costs are calculated separately for each Order and are displayed during checkout, based on the information available at that time.
Shipping costs may depend on:
· destination and postcode;
· delivery area;
· total actual and volumetric weight;
· number and dimensions of parcels;
· quantity and type of Products;
· Ambient, Fresh or Frozen temperature category;
· insulated packaging;
· water-based cooling packs, gel packs or dry ice;
· expected transit time;
· remote-area or island surcharges;
· customs requirements; and
· Carrier and service availability.
Orders containing Fresh or Frozen Products require specialised temperature-controlled packaging. Adding even one Fresh or Frozen Product may therefore activate a fixed packaging and temperature-control cost. Once this service has been activated, adding additional Products of the same temperature category may increase the total shipping cost only gradually.
The shipping quotation is generated by an automated system. We make reasonable efforts to ensure that it is accurate; however, because the calculation depends on several technical and logistical variables, an incorrect, incomplete or temporary backup rate may occasionally appear.
A rate displayed as €0.00, or another clearly incorrect placeholder amount, does not constitute free shipping and may indicate a temporary backup rate or technical synchronisation problem.
Before dispatching the Order, we may verify the actual shipping cost. If the quotation shown at checkout is clearly incorrect or incomplete, we will contact the Customer before shipment and offer the Customer the choice to:
· accept and pay the corrected shipping cost;
· select an available alternative shipping service; or
· cancel the Order and receive a full refund of the amount paid.
No additional shipping charge will be applied without informing the Customer and obtaining the Customer’s agreement before dispatch.
14. PLACING AN ORDER
The Customer may place an Order by following the checkout procedure on the Website.
Depending on the checkout options available, the Customer may place an Order:
· through a registered customer account; or
· as a guest.
Before submitting the Order, the Customer must check:
· the Products selected;
· quantities;
· prices;
· delivery address;
· billing details;
· telephone number;
· email address;
· selected shipping method; and
· payment information.
By clicking the final order or payment confirmation button, the Customer submits a binding offer to purchase the selected Products.
15. ORDER CONFIRMATION AND ACCEPTANCE
After the Order has been submitted, the Customer will normally receive an automatic email acknowledging receipt of the Order.
This automatic acknowledgement does not necessarily constitute final acceptance of the Order.
The sales contract is concluded when we:
· expressly confirm acceptance of the Order;
· begin preparing the Order;
· issue the final invoice or receipt; or
· dispatch the Order,
whichever occurs first.
We reserve the right to refuse or cancel an Order where reasonably necessary, including in cases of:
· unavailable Products;
· suspected fraud;
· payment failure;
· failure to complete payment authentication;
· incorrect or incomplete customer information;
· incorrect or undeliverable address;
· import restrictions;
· inability to provide a safe or suitable shipping service;
· technical or pricing errors;
· abusive or unlawful conduct;
· repeated unjustified refusal of deliveries; or
· any other reasonable operational, legal or safety concern.
If an Order is refused or cancelled after payment, the amount received for the cancelled Products will be refunded.
16. ORDER MODIFICATIONS AND CANCELLATIONS
The Customer must contact us as soon as possible to request a modification or cancellation.
An Order may not be modified or cancelled once:
· preparation has begun;
· fresh Products have been ordered specifically for the Customer;
· variable-weight Products have been cut or prepared;
· personalised Products have been prepared;
· meals have been cooked or packed;
· insulated packaging has been prepared;
· refrigerants or dry ice have been purchased specifically for the shipment; or
· the shipment has been handed to the Carrier.
We will make reasonable efforts to accommodate cancellation requests, but cancellation is not guaranteed.
Where cancellation is accepted, we may deduct reasonable and documented costs already incurred, to the extent permitted by applicable law.
Mandatory Consumer rights remain unaffected.
17. PAYMENT METHODS
The payment methods available are those displayed during checkout.
Available methods may vary according to:
· destination country;
· currency;
· Order amount;
· payment provider;
· risk assessment; and
· technical availability.
Payment may require authentication through systems such as 3D Secure.
The Customer is responsible for completing any authentication requested by their bank or payment provider.
If authentication is not completed or the issuing bank refuses authorisation, the payment and Order may fail.
We do not have control over payment refusals issued by the Customer’s bank or payment provider.
Where an initial authorisation or temporary card hold is used, the bank may temporarily reserve the amount before the final charge is completed.
The time required to release an unsuccessful or unused authorisation depends on the Customer’s bank.
18. FRAUD PREVENTION AND PAYMENT VERIFICATION
For security and fraud-prevention purposes, we may request additional information before accepting or shipping an Order, including:
· proof of identity;
· confirmation of billing address;
· confirmation of delivery address;
· proof of payment;
· cardholder confirmation;
· company registration information; or
· other documents reasonably required by the payment provider.
Failure to provide the requested information may result in cancellation and refund of the Order.
19. INVOICES AND TAX DOCUMENTS
Invoices, receipts and other tax documents will be issued in accordance with the fiscal rules applicable to the transaction and to the Seller.
The Customer must provide complete and accurate billing information when required.
Customers requesting an invoice must provide all required details, which may include:
· full legal name;
· billing address;
· Italian Tax Code;
· VAT number;
· SDI recipient code;
· PEC address;
· valid European VAT number; or
· other national tax identification number.
An invoice may not be modified after issuance where modification is prohibited or restricted by applicable fiscal rules.
20. DELIVERY AREAS
We deliver only to destinations and postcodes supported by the shipping services available through the Website or expressly confirmed by us.
Some Products cannot be shipped to certain destinations because of:
· carrier restrictions;
· temperature requirements;
· transit time;
· import restrictions;
· customs regulations;
· food safety concerns;
· remote-area limitations; or
· local law.
The availability of a destination during checkout does not constitute an absolute guarantee that every Product can legally or safely be delivered there.
We may contact the Customer before shipment where additional checks are required.
21. DELIVERY TIMES
Delivery dates and transit times displayed on the Website or communicated by us are estimates, unless a specific guaranteed delivery service has been expressly agreed in writing.
Estimated delivery times may be affected by:
· weekends;
· public holidays;
· religious holidays;
· carrier operating schedules;
· seasonal volume;
· customs controls;
· remote locations;
· islands;
· mountain areas;
· severe weather;
· strikes;
· accidents;
· public authority measures;
· import inspections;
· incorrect customer information; or
· events beyond our reasonable control.
The estimated transit time begins when the parcel is collected by the Carrier, not when the Order is placed.
Preparation time and transit time are separate.
Fresh and Frozen Products may be shipped only on specific days to reduce the risk of weekend or holiday delays.
The following transit times are general estimates only and may change according to destination, postcode, Carrier availability and seasonal conditions:
· Italy: generally 24–48 hours for North and Central Italy, and 48–96 hours for South Italy, islands and remote areas;
· European economy services: generally 3–6 business days;
· European express services: generally 24–48 hours;
· worldwide express services: generally 2–3 business days, excluding customs delays.
Orders requiring an expected transit time of four days or more are normally dispatched on Monday, provided that the Order has been received and accepted before the applicable cut-off time.
The normal cut-off time is 8:00 a.m. Italian time. Orders received after the cut-off may be dispatched on the next suitable business day. Same-day dispatch is not guaranteed and remains subject to stock availability, preparation requirements, Carrier collection schedules, public holidays and operational capacity.
22. CUSTOMER RESPONSIBILITY FOR DELIVERY INFORMATION
The Customer is responsible for providing complete and accurate delivery information, including:
· recipient’s full name;
· company or accommodation name, where applicable;
· street name;
· house number;
· building;
· floor;
· apartment;
· postcode;
· city;
· province or region;
· country;
· doorbell or intercom name;
· access instructions;
· valid email address; and
· valid telephone number reachable in the destination country.
The Customer must check all delivery information before submitting the Order.
We are not responsible for delivery problems caused by incorrect, incomplete or misleading information provided by the Customer.
Any additional costs resulting from incorrect information may be charged to the Customer, including:
· address correction;
· redirection;
· storage;
· repeated delivery;
· return to sender;
· disposal;
· customs handling;
· new packaging; and
· reshipment.
For international deliveries, the Customer is strongly advised to provide a local telephone number that the Carrier can contact.
23. PRESENCE AT THE DELIVERY ADDRESS
The Customer or an authorised adult representative must be available to receive the shipment at the delivery address.
The Customer is responsible for monitoring the tracking information and ensuring that the shipment can be accepted promptly.
The Carrier is not always required to telephone before delivery.
Failure to receive a telephone call does not excuse the Customer’s absence where tracking information or a delivery notice was available.
For Fresh, Frozen and Perishable Products, immediate acceptance is particularly important.
24. MISSED DELIVERY
If delivery cannot be completed, the Carrier may, according to its own procedures:
· attempt delivery again;
· contact the Customer;
· request new instructions;
· leave the parcel at an authorised collection point;
· hold the parcel at a depot;
· redirect the shipment;
· return the shipment to us; or
· dispose of the shipment where required for safety or operational reasons.
The Customer must contact the Carrier and us promptly after a failed delivery.
If delivery fails due to circumstances attributable to the Customer, including absence, incorrect address, inaccessible premises, non-functioning intercom, invalid telephone number, refusal of delivery or failure to provide customs information, the Customer may remain responsible for:
· shipping costs;
· storage costs;
· return costs;
· redelivery costs;
· customs costs;
· repacking costs; and
· the value of Products that can no longer be resold or safely delivered.
Perishable Products may not be refundable where they deteriorate because the Customer failed to accept or collect the shipment promptly.
Mandatory Consumer rights remain unaffected.
25. DELIVERY TO HOTELS, HOLIDAY HOMES, RECEPTION DESKS AND THIRD PARTIES
Where delivery is requested to a hotel, residence, holiday property, restaurant, business, concierge, reception desk, neighbour, collection point or other third party, delivery to that person or location may be considered completed delivery to the Customer.
The Customer must obtain permission from the relevant person or establishment before using that address.
We are not responsible for loss, delay, improper storage or mishandling occurring after the shipment has been accepted at the address provided by the Customer.
26. TRANSFER OF RISK
For Consumers, risk of loss or damage passes to the Customer when the Customer, or a third party designated by the Customer other than the Carrier, physically receives the Products, subject to mandatory applicable law.
Where the Customer independently appoints a Carrier that was not proposed by us, risk may pass to the Customer when the Products are delivered to that Carrier, where permitted by law.
For Professional Customers, risk passes when the Products are handed over to the Carrier, unless otherwise agreed in writing.
27. INSPECTION OF THE PARCEL AT DELIVERY
At the time of delivery, the Customer must inspect the external condition of the parcel before accepting it.
The Customer should check whether the parcel is:
· crushed;
· torn;
· open;
· wet;
· punctured;
· resealed;
· visibly damaged;
· missing a seal;
· leaking; or
· otherwise irregular.
If visible damage or tampering is present, the Customer must ask the Carrier to record a specific written reservation on the delivery receipt or electronic proof of delivery.
The reservation should describe the actual problem, for example:
· “parcel crushed”;
· “box open”;
· “packaging torn”;
· “parcel wet”;
· “seal broken”; or
· “contents making broken-glass noise”.
A generic statement such as “subject to inspection” may not be sufficient for a Carrier claim.
Where permitted and reasonably possible, the Customer should refuse a parcel that is seriously damaged, open or visibly unsafe.
28. OPENING AND CHECKING THE PARCEL
The Customer is requested to open and inspect the shipment immediately after delivery.
Fresh, Frozen, Refrigerated and Perishable Products must be checked without delay.
The Customer must verify:
· the condition of the external box;
· the condition of insulated packaging;
· the presence and condition of refrigerants;
· the condition of the Products;
· the number of Products received;
· visible breakages;
· leakage;
· signs of tampering;
· signs of thawing or deterioration; and
· any discrepancy with the Order.
The Customer must immediately place the Products under the correct storage conditions stated on their packaging.
29. REPORTING DAMAGE, MISSING PRODUCTS OR DELIVERY PROBLEMS
Any damage, breakage, missing Product, incorrect Product, temperature concern, tampering or other delivery irregularity must be reported to us without undue delay.
To allow us to investigate and, where appropriate, submit a claim to the Carrier, the Customer is requested to notify us within 24 hours of delivery.
The report must be sent to:

The report should include:
· Order number;
· tracking number;
· delivery date and approximate delivery time;
· description of the problem;
· photographs of every external side of the parcel;
· photograph of the shipping label;
· photographs showing any visible external damage;
· photographs of the parcel immediately after opening;
· photographs of the internal packaging;
· photographs of insulation and refrigerants;
· photographs of every affected Product;
· photograph of the product label and expiry date, where relevant; and
· copy or photograph of any delivery reservation made with the Carrier.
The Customer must not dispose of:
· the external box;
· shipping label;
· internal packaging;
· insulation;
· refrigerants;
· damaged Products; or
· broken packaging,
until we confirm that they are no longer required for inspection or a Carrier claim.
A delayed report or failure to provide the requested evidence may make it impossible to establish when or how the damage occurred or to submit a valid claim to the Carrier.
A notification made after several days may be particularly difficult to assess because we cannot verify how the parcel and Products were handled, stored or moved after delivery.
Nothing in this section excludes any mandatory statutory right of a Consumer.
30. DAMAGED PARCELS REPORTED LATE
Where a problem is reported several days after delivery, we will review the information reasonably available.
However, unless required otherwise by mandatory law, we may be unable to accept responsibility where:
· the parcel was not inspected promptly;
· no delivery reservation was recorded;
· the external packaging has been discarded;
· photographs of the original condition are unavailable;
· the Products were moved or stored after delivery;
· the Products were handled by warehouse staff, hotel staff or other third parties;
· other goods were placed on top of the parcel;
· the parcel was dropped or damaged after delivery; or
· the delay prevents a claim from being made against the Carrier.
Each case will be considered on the basis of the available evidence and applicable law.
31. TEMPERATURE-CONTROLLED PRODUCTS
Fresh and Frozen Products are prepared and packed using methods selected according to:
· Product category;
· destination;
· expected transit time;
· season;
· external temperature;
· parcel dimensions; and
· Carrier service.
Packaging may include:
· insulated boxes;
· thermal liners;
· water-based cooling packs;
· gel packs;
· dry ice;
· separators;
· absorbent materials; or
· protective packaging.
The packaging is designed to preserve the Products during the reasonably expected transit period.
It is not designed for indefinite storage or for delays caused by missed delivery, incorrect addresses, refusal, prolonged customs detention or failure to collect the parcel.
32. DRY ICE SAFETY
Some Frozen shipments may contain dry ice.
Dry ice is extremely cold and may cause injury if handled incorrectly.
The Customer must:
· avoid touching dry ice with bare hands;
· keep it away from children and animals;
· not place it in the mouth;
· not store it in an airtight container;
· not store it in a closed vehicle or unventilated room;
· allow it to evaporate naturally in a well-ventilated area; and
· follow any safety instructions included with the shipment.
The absence of visible dry ice at the time of opening does not, by itself, prove that the Products were transported incorrectly, because dry ice naturally sublimates during transit.
33. CONDITION OF FROZEN PRODUCTS AT DELIVERY
The Customer must inspect Frozen Products immediately.
A Frozen Product may still be suitable for safe storage or consumption even if some surface softening has occurred, depending on:
· the Product;
· its internal temperature;
· the duration of exposure;
· manufacturer instructions; and
· applicable food safety guidance.
The Customer must not consume a Product where there is a reasonable concern about its safety.
The Customer should photograph the Product, keep it stored safely and contact us immediately for assessment.
We may request temperature measurements taken with a suitable thermometer.
A visual photograph alone may not always establish the internal temperature or safety of a Product.
34. STORAGE AFTER DELIVERY
Our responsibility for maintaining the shipping packaging and cold-chain arrangements ends when the shipment is delivered to the Customer or the Customer’s designated recipient, subject to mandatory applicable law.
After delivery, the Customer is responsible for:
· opening the parcel promptly;
· removing the Products from shipping packaging;
· storing each Product at the temperature stated on its label;
· refrigerating chilled Products immediately;
· freezing Frozen Products immediately where appropriate; and
· following all manufacturer instructions.
We are not responsible for deterioration caused by incorrect storage or handling after delivery.
35. PREPARED MEALS AND READY MEALS
Prepared meals and ready meals may be supplied fresh, chilled or deep frozen, as indicated on the relevant Product page.
Unless expressly stated otherwise, prepared meals are not supplied ready for immediate consumption and may require:
· refrigeration;
· freezing;
· defrosting;
· reheating; or
· cooking.
The Customer must follow the storage and preparation instructions supplied with the Product.
Products delivered frozen must be stored frozen immediately.
A Product must not be refrozen after complete thawing unless this is expressly permitted by the manufacturer’s instructions or appropriate food safety guidance.
36. DELAYS AND EVENTS BEYOND OUR CONTROL
We are not responsible for delay or failure caused by events outside our reasonable control, including natural disasters, severe weather, floods, snow, fires, accidents, epidemics, pandemics, war, terrorism, civil disturbance, strikes, Carrier network disruption, road closures, aviation disruption, border controls, customs inspections, government action, power failure, telecommunications failure, cyber incidents or interruption of supplier operations.
Where such an event occurs, we will make reasonable efforts to inform the Customer and identify an appropriate solution.
Mandatory Consumer rights remain unaffected.
37. INTERNATIONAL DELIVERIES AND CUSTOMS
The Customer is responsible for verifying whether the Products may lawfully be imported into the destination country.
International deliveries may be subject to:
· customs inspections;
· import duties;
· VAT;
· local taxes;
· brokerage charges;
· food import controls;
· health certificates;
· sanitary controls;
· import permits;
· quantity restrictions; and
· personal or business identification requirements.
Unless expressly included during checkout, these charges are not included in the Product or shipping price and are payable by the recipient.
The Customer must provide any information required for customs clearance, which may include:
· passport details;
· national tax number;
· VAT number;
· EORI number;
· EIN;
· company registration number;
· import permit;
· power of attorney; or
· other documentation required by the destination country.
We do not guarantee that customs or public authorities will permit a Product to enter the destination country.
38. CUSTOMS DELAYS, REFUSALS AND DESTRUCTION
We are not responsible for delays caused by customs or other public authorities where the delay is outside our reasonable control.
If a shipment is delayed, refused, returned, confiscated or destroyed because:
· the Customer failed to provide required information;
· the Customer failed to pay import charges;
· the Products are prohibited at destination;
· the Customer provided incorrect information;
· the recipient refused the shipment; or
· the Customer failed to cooperate with customs,
the Customer may be responsible for all resulting costs and for the value of Perishable Products that cannot be recovered or resold.
Where a Product is prohibited in the destination country despite the Customer having provided accurate information, we will assess the matter individually in accordance with applicable law and the information reasonably available when the Order was accepted.
39. RIGHT OF WITHDRAWAL FOR CONSUMERS
Subject to the exclusions set out below, a Consumer may withdraw from an eligible distance sales contract within 14 days without giving a reason.
The withdrawal period normally expires 14 days after the day on which the Consumer, or a third party designated by the Consumer other than the Carrier, acquires physical possession of the Products.
For Orders containing multiple Products delivered separately, the period normally begins when the final Product is received.
To exercise the right of withdrawal, the Consumer must send a clear statement of the decision to withdraw to:

The withdrawal communication must be sent before the withdrawal period expires.
40. EXCLUSIONS FROM THE RIGHT OF WITHDRAWAL
The statutory right of withdrawal does not apply, to the extent permitted by applicable law, to Products that are:
· liable to deteriorate or expire rapidly;
· fresh;
· chilled;
· refrigerated;
· frozen;
· perishable;
· prepared specifically for the Customer;
· made to the Customer’s specifications;
· clearly personalised;
· sealed for health-protection or hygiene reasons and unsealed after delivery; or
· otherwise excluded by applicable law.
This may include, depending on the circumstances:
· meat;
· poultry;
· fish;
· dairy products;
· cured meats;
· delicatessen Products;
· fresh bakery Products;
· prepared meals;
· chilled Products;
· Frozen Products; and
· opened food Products.
The exclusion from the right of withdrawal does not remove the Customer’s rights where a Product is defective, damaged, unsafe, incorrectly supplied or otherwise non-conforming.
41. RETURNS FOLLOWING WITHDRAWAL
Where the right of withdrawal applies, the Consumer must return the Products without undue delay and no later than 14 days after communicating the withdrawal.

Unless otherwise required by law, the Consumer bears the direct cost of returning the Products.
The Consumer must take reasonable care of the Products and may be liable for any reduction in value caused by handling beyond what is necessary to establish their nature, characteristics and functioning.
Food Products, sealed Products and hygiene-sensitive Products must not be opened where opening would remove the right of withdrawal.
The Customer must contact us before returning any Product.
Returns sent without prior communication may be refused where permitted by law.
42. REFUNDS FOLLOWING WITHDRAWAL
Where a valid withdrawal applies, we will refund payments received for the relevant Products, including the cost of the least expensive standard delivery method offered for the Order, where required by law.
Additional delivery costs chosen by the Consumer, including express, premium, refrigerated or special delivery charges beyond the standard delivery option, may not be refundable to the extent permitted by law.
We may withhold the refund until:
· the returned Products have been received; or
· the Consumer provides evidence that the Products have been sent back,
whichever occurs first, unless we have offered to collect them.
Refunds will normally be made using the same payment method used for the original transaction, unless otherwise expressly agreed.

44. LEGAL GUARANTEE OF CONFORMITY
Consumers benefit from the mandatory legal guarantee of conformity provided by applicable law.
A Product may be non-conforming where, for example, it:
· does not correspond to the Order;
· is defective;
· does not possess the qualities reasonably expected;
· is not suitable for its normal purpose; or
· does not correspond to the description provided.
The legal guarantee does not cover problems caused by:
· normal deterioration;
· expiry after delivery;
· improper storage;
· failure to refrigerate or freeze promptly;
· incorrect preparation;
· misuse;
· damage caused after delivery;
· failure to follow instructions; or
· circumstances attributable to the Customer.
Because food Products may deteriorate rapidly, the Customer should report any apparent non-conformity as soon as possible and provide the evidence listed in the claims section.
Mandatory statutory deadlines and rights remain unaffected.
45. REMEDIES FOR DAMAGED OR NON-CONFORMING PRODUCTS
Where a Product is confirmed to be damaged, missing, incorrect or non-conforming, the available remedy will be determined according to applicable law and the circumstances.
The remedy may include:
· replacement;
· partial refund;
· full refund;
· price reduction;
· store credit, only with the Customer’s agreement; or
· another appropriate solution.
We may request the return, preservation or disposal of the Product.
The Customer must not discard the Product before receiving instructions where the Product may be required for inspection or evidence.
46. PROFESSIONAL CUSTOMERS
Professional Customers must inspect the Products and packaging immediately upon delivery.
Visible damage, shortages or discrepancies must be recorded with the Carrier and reported to us in writing within 24 hours of delivery, together with the required photographic evidence.
Hidden defects must be reported promptly after discovery and within any mandatory legal deadline.
To the maximum extent permitted by law, our liability to a Professional Customer shall not exceed the amount paid for the specific Product giving rise to the claim.
We shall not be liable to a Professional Customer for:
· loss of profit;
· loss of business;
· loss of opportunity;
· loss of goodwill;
· loss of contracts;
· indirect loss;
· consequential loss; or
· third-party claims,
except where liability cannot legally be excluded or limited.
47. LIMITATION OF LIABILITY
Nothing in these Terms and Conditions excludes or limits liability where exclusion or limitation is prohibited by law, including liability for fraud, wilful misconduct, gross negligence where applicable, death or personal injury caused by negligence, or mandatory Consumer rights.
Subject to the above, we are not responsible for loss caused by:
· incorrect information provided by the Customer;
· failure to follow storage or preparation instructions;
· improper handling after delivery;
· delay in reporting a problem;
· unauthorised third-party handling;
· use of the Products contrary to their intended purpose;
· allergy or intolerance where label information was available and accurate;
· circumstances beyond our reasonable control; or
· restrictions imposed by authorities at destination.
48. CUSTOMER CONDUCT AND SUSPENSION OF SERVICE
We may suspend or refuse service where a Customer:
· fails to pay amounts due;
· repeatedly refuses deliveries without valid reason;
· repeatedly provides incorrect information;
· abuses refund or claim procedures;
· makes fraudulent claims;
· threatens or harasses staff, couriers or suppliers;
· uses the Website unlawfully;
· attempts payment fraud; or
· commits another serious breach of these Terms and Conditions.
Where appropriate, we will notify the Customer in writing.
Suspension does not affect obligations already accrued.
49. INTELLECTUAL PROPERTY
All Website content, including text, images, logos, graphics, product descriptions, layout, design and software, is owned by or licensed to HAMASHBIR DI ELMALEH GAD unless otherwise indicated.
Content may not be copied, reproduced, distributed, commercially exploited or modified without prior written permission, except as permitted by law.
Third-party trademarks remain the property of their respective owners.

The Customer should include the Order number in all communications.
We aim to respond to customer-service enquiries within 24 business hours, although longer response times may apply during weekends, public holidays, religious holidays and peak periods.
53. ALTERNATIVE DISPUTE RESOLUTION
Consumers may have access to an alternative dispute resolution body where the conditions required by applicable law are met.
The former European Online Dispute Resolution platform was discontinued on 20 July 2025. Information on recognised consumer dispute resolution bodies is available through the European Commission’s Consumer Redress portal.
Nothing in this section prevents a Consumer from bringing proceedings before the competent courts.
54. GOVERNING LAW AND JURISDICTION
These Terms and Conditions and the related sales contracts are governed by Italian law, without prejudice to any mandatory protection granted to Consumers by the law of the country in which they habitually reside.
For Consumers, any dispute shall be submitted to the court having jurisdiction under mandatory Consumer protection rules, normally including the court of the Consumer’s place of residence or domicile where applicable.
For Professional Customers, the Court of Milan shall have exclusive jurisdiction, unless otherwise required by mandatory law or agreed in writing.
55. SEVERABILITY
If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, that provision shall be interpreted or limited to the minimum extent necessary.
The remaining provisions will continue in full force and effect.
56. NO WAIVER
A failure or delay in exercising any right under these Terms and Conditions does not constitute a waiver of that right.
Any waiver must be express and applies only to the specific circumstances for which it is granted.
57. ENTIRE AGREEMENT
These Terms and Conditions, together with the Order confirmation, Privacy Policy, Cookie Policy and any specific conditions expressly accepted by the Customer, constitute the agreement between the Seller and the Customer concerning the Order.
In the event of conflict, specific written conditions agreed for an individual Order will prevail over these general Terms and Conditions.
58. LANGUAGE
These Terms and Conditions may be made available in more than one language.
In the event of inconsistency between translations, the English version shall prevail, to the extent permitted by law.
Consumer rights based on mandatory local-language information requirements remain unaffected.
